Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website primeapi.co and the PrimeApi API service (together, the "Service"), operated by PrimeApi ("PrimeApi", "we", "us" or "our"). By creating an account, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of terms

By registering for or using the Service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), that you have the authority to enter into these Terms, and that you will comply with these Terms and all applicable laws.

2. Description of the Service

PrimeApi provides a credit-based REST API that returns publicly available TikTok data in real time, currently across 30 endpoints in 8 categories. The API base URL is https://api.primeapi.co/. Each successful request consumes 1 credit, the default rate limit is 100 requests per minute, and your remaining balance is returned in the X-PrimeAPI-Balance response header. We may add, change, deprecate or remove endpoints and features at any time.

3. Accounts

To use the API you must create an account with accurate information. You are responsible for all activity under your account and for maintaining the confidentiality of your credentials. New accounts receive 50 free credits. We may suspend or terminate accounts that violate these Terms or are associated with fraud, abuse or temporary/disposable email addresses.

4. API key responsibility

Your API key, available on your profile page, authenticates your requests via the X-PrimeAPI-Key header. You must keep your API key secret. You are responsible for all requests and credit consumption made with your key, whether or not authorized by you. If you believe your key has been compromised, contact us immediately. We are not liable for losses arising from unauthorized use of your key resulting from your failure to keep it secure.

5. Acceptable use

You agree to use the Service lawfully and responsibly. You must not:

• use the Service in violation of any applicable law or regulation, or of TikTok's own terms, policies or applicable rights;
• attempt to circumvent rate limits, credit metering, authentication or other technical controls;
• resell, sublicense or redistribute raw API access in a way that competes with or substitutes for the Service without our written permission;
• use the Service to harass, stalk, defame, or infringe the privacy or intellectual property rights of others;
• collect or use personal data obtained through the Service in a manner that violates applicable data protection laws;
• introduce malware, overload, disrupt or otherwise abuse the Service or its infrastructure.

You are solely responsible for how you use the data returned by the API and for ensuring your use complies with all applicable laws and third-party terms.

6. Credits and payment

Access is metered in credits. Paid credit packages are priced in USD and paid in cryptocurrency through our payment provider, Cryptomus. Credits are added to your account once the network confirms the transaction. Current plans are:

• Free: 50 credits on sign-up.
• Basic: $9.90 for 2,500 credits.
• Pro: $59.90 for 50,000 credits.
• Ultra: $99.90 for 150,000 credits.
• Enterprise: $279.00 for 500,000 credits.

Prices and credit amounts may change; the prices shown at the time of purchase apply. Credits are added to your balance upon successful payment. Refunds and cancellations are governed by our Refund & Cancellation Policy. We do not accept card payments: the payment itself is handled entirely by Cryptomus, and no payment card data is collected or stored by us.

7. Intellectual property

The Service, including the website, software, documentation, branding and the design of the API, is owned by PrimeApi and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. We claim no ownership over the underlying TikTok data, which belongs to its respective owners.

8. Disclaimer; unofficial service

PrimeApi is an independent, unofficial service. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to TikTok or ByteDance Ltd. All TikTok and ByteDance trademarks belong to their respective owners.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Because the Service relies on a third-party data source we do not control, we do not warrant that the data will be accurate, complete, current, uninterrupted or available, or that the Service will be error-free.

9. Limitation of liability

To the maximum extent permitted by law, PrimeApi and its owners, officers and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid to us for the Service in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend and hold harmless PrimeApi and its owners, officers and suppliers from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and indemnification) will survive.

12. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. The competent courts of the Republic of Türkiye shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service, to the extent permitted by applicable law.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
